You're right he's on 9 yellows, so one more will lead to a suspension. However it looks like such suspensions don't carry over to Cup games:

 

Under The FA's rules, players who receive a total of 10 yellow cards in their side's first 32 Premier League matches receive a two-match suspension. Yellow cards are not carried over to the EFL Cup or FA Cup.
