wykikitoon 21519 Posted November 17, 2009 Share Posted November 17, 2009 I have recently sold my house and before I bought a new one I decided to rent for a few months as I wanted to see about the possibilities of moving abroad. Anyways. I saw some place I liked, and put in an application. The letting agency have a good reputation and I wasnt worried. Anyways after nearly a week of submitting my application I hadnt heard anything so phoned up and the branch mananger (also chap who showed me around the place) said that because of no application he thought I had given up. Now this was despite a couple of emails with questions on regarding the place. Soooo, he finally got my application (delayed due to postal strikes) and thats where the fun began. He wanted a payment of part deposit part application fee. So I asked is bank transfer ok, he said yes but prefer card payment or cash into a bank. So, I had to juggle some funds about and paid. Now, I asked for a move date of the 14th and he then said because of the late application it maybe too late. Couple of days pass then I get a call from him asking if the 21st is ok as the landlord still has to get the heating checked and certified and he needs to fit a meter to electric and also tidy up. I was pretty pissed with this but agreed. Sooooo as I get paid on the last day of each month I asked if I could pay my rent on the 1st of each month. He said it could be a possibility but I may have to pay some for the final week I would be living there, but obvisoulsy it would be pro-rated and he would speak to the landlord for me. Now, on Saturday I got a bill with how much I need to pay before I move in. He basically hasnt taken in this pro-rata thingy at all. Theres more. I got an email this morning asking if the landlord can put in a clause of where he can terminate the contract with 1months notice incase he sells the place?! So all the above has pissed me off. Where do I stand? The landlord clearly is unorganised and shite, so if anything goes wrong in the place I want it sorting and not have to wait time The letting agent doesnt know communication well (on emails he calls me Giles, Miles or Martin) even though my name is CLEARLY on the emal AND signature) So basically I dont want the place yet want my money back! There's no cooling off period with a tenancy agreement - once it's signed, you're committed. It's not covered by distance selling regulations as that covers products that you may not have seen before purchase The only way to get out of a tenancy agreement once you've signed it is to try to come to some mutual agreement with the landlord. If s/he is feeling generous, or if they know they can get someone else, then they might let you break the contract. They aren't under any obligation to do this though, and could (in the worst case scenario) demand that you pay the rent until the end of the contract. However, if you make an effort to find a new tenant then they should be more amenable to helping you. If you have not signed a contract then you are probably reliant on good will as they could take your money as they might, I'd imagine, percieve you have messed them around. trophyshy 7099 Posted November 17, 2009 Share Posted November 17, 2009 (edited) Well say you don't want the clause in the contract, say you no longer want the contract as it has taken too long to sort out or you have had a change of circumstances and you want your money back. Things is your security deposit may also be a deposit to hold the place, the fact you change your mind, despite the problems will offer them license to try and keep your money. And any fees, well you'll almost certainly lose those. If I were you I would make up some tragedy and appeal to their better nature. If they get arsey however tell them you know Jay Jay Sea.
