legal copyright type question

If a website such as this one was to display a load of youtube videos which were of copyrighted material then would we be in breach of copyright or whatever else illegal?

 

My question doesnt relate to here but to another site where the designer is assuring me its fine to display loads of youtube material of television programmes etc because the site isnt hosting them.

 

Is he right?

If you're merely linking it, as you are able to here, then no you should be fine as youtube is the host, it is their responsibility to disable the link.

That's why youtube constantly check and remove any material they feel the member isn't the copyright owner - something you see here often when someone posts something then the link is killed.

 

If your designer is uploading them to youtube so your site can link them, then you may have issues.

They've also stopped some things being linkable now, even if they are still directly on their site.

 

 

 

:o about the legal position, would guess it was youtube not the 3rd parties problem though, but it would take a property conveyubermancer to know for sure.

Wasn't that Pirate Bay's defence? Didn't hold up for them.

 

Never followed the case as I'm nowt to do with IP law, however I should imagine the technicalities of 'hosting' would be a bit of a red herring. The second site would still be publishing the material on it's pages even if it was youtube that was 'hosting' it (whatever that actually means anyway).

 

In a practical sense I'd imagine they'd only bother going after youtube in the event of a breach because it's youtube's technology that enables the publication and because youtube have the deeper pockets, but that doesnt mean the second site wouldn't be vulnerable.
