wor lass quit her job at the end of jan, the company paid her 1 months wage in error!! no-one told payroll she had left :lol: anyway can they try and claim the money back, we got a letter today saying they will take it further unless we pay it back, way i see it is its their bloody fault for doing it, anyhooo can someone help

Get the union involved? They've accidentally paid her for work she hasn't done, I imagine any union would tell her to give them the money back.

No. If you accidentally submitted payment for something online twice, would you expect the retailer to give you your cash back?

 

I'm afraid the "tough titty" defence rarely stands up in court. :lol:

I'm currently paying back a £1200 ish overpayment on my salary cos the HR people fucked it up - so this type of thing really gets me wound up.

 

 

my employer, the dwp, say that any overpayment, no matter what the reason, has to be repaid. no exceptions. ever.

 

though thats probably due to it being public funds.......but still :lol:

Errr, no, it's due to you being not entitled to it. :lol: If it was a gradual overpayment - i.e. they were overpaying you £60 a month for a long time, then I can sort of feel your pain, but if you had £1200 pop up in your account all at once and you knew it was a mistake, you shouldn't have spent it in the first place.

pay it back. I got away with it by having folk ITK, but I'd definitely not suggest trying to fight them for it. Like Scott says, you'd demand repayment for some cock up online purchase.

Aye, they overpaid me once, and while it was nice to see a canny wodge in my back account, I had no choice but to pay it back. She didn't work it, cock up or not, you have to legally give it back I'm afraid. If they'd underpaid her (which the bastids have done to me twice) you'd quite rightly want the money asap. Tit for tat.

Aye - but when you spend all day writing off £5428, £3289 and £9212 overpayments due to 'departmental error' it pisses you off.

Of course you have to give it back. If you have spent it (pretty stupid if you have), they might let you pay back in installments, that's about it. This is an example of "something for nothing" culture really.

 

I was overpaid a grand at christmas as it happens. I paid it back immediately, even though my employers owe me at least that much in backdated pay. On reflection, I shouldn't have paid it 'til my own pay was sorted tbh, it's been dragging on for years now.
